Terms of Service

1. Acceptance of Terms
By accessing or using Blumify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Blumify provides a lead generation and audit platform that discovers local businesses, performs automated technical audits, scores leads, and generates outreach content. The Service is provided on a subscription basis. Features vary by plan as described on the Pricing page.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to terminate accounts that violate these Terms.
4. Payments and Refunds
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. You authorise us to charge your payment method on a recurring basis until you cancel. Plan changes are prorated as described in the FAQ.
5. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) send unsolicited bulk messages in violation of applicable law; (c) scrape or harvest data from third parties in violation of their terms of service; (d) interfere with or disrupt the integrity or performance of the Service; (e) attempt to gain unauthorised access to any part of the Service. We reserve the right to suspend or terminate access for violations of this policy.
6. Intellectual Property
Blumify and its licensors own all right, title, and interest in and to the Service, including all intellectual property rights. You retain ownership of any data you upload or generate through the Service. You grant Blumify a limited licence to process your data solely to provide the Service.
7. Third-Party Services
The Service integrates with third-party services including Google Maps API, Clerk (authentication), Stripe (payments), and Supabase (infrastructure). Your use of the Service is also subject to the terms and privacy policies of these providers. We are not responsible for the practices of third-party services.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUMIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the jurisdiction where Blumify is incorporated, as applicable.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
